Terms of Service

1. Acceptance of Terms

By creating an account or using any part of the Service, you confirm that you are at least 18 years old, have the legal capacity to enter into these Terms, and agree to comply with them in full. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

2. Use of the Service

AgentPostKit provides a social media content management platform for real estate professionals. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable license to access and use the Service for your personal or internal business purposes.

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately at hello@agentpostkit.com if you suspect unauthorized access.

3. Subscription and Billing

Free trial

New accounts receive a free trial period as indicated at signup. No payment method is required during the trial. At the end of the trial, you must subscribe to continue using the Service.

Paid plans

• Subscriptions are billed monthly in advance.
• All fees are non-refundable except as required by applicable law.
• We reserve the right to change pricing with 30 days' notice via email.
• Payments are processed by Stripe. By subscribing, you agree to Stripe's terms.

Cancellation

You may cancel your subscription at any time from your Settings page. Cancellation takes effect at the end of the current billing period; you retain access until then.

4. Intellectual Property

The Service and its original content, features, and functionality — including but not limited to the content library, templates, and software — are and will remain the exclusive property of AgentPostKit and its licensors.

You retain ownership of any original content you create using the Service. By using the Service to publish content, you represent that you have the right to do so and that your content does not infringe third-party rights.

5. Prohibited Activities

You agree not to:

• Use the Service to violate any applicable local, national, or international law
• Transmit spam, unsolicited messages, or bulk commercial communications
• Upload or transmit viruses, malware, or other harmful code
• Attempt to gain unauthorized access to any part of the Service or its systems
• Reverse-engineer, decompile, or disassemble any part of the Service
• Use automated tools (bots, scrapers) to access the Service without our written consent
• Impersonate any person or entity, or misrepresent your affiliation
• Use the Service in any way that could harm, disable, overburden, or impair its availability or accessibility

6. Termination

We may suspend or terminate your access to the Service at any time, with or without cause or notice, including if we reasonably believe you have violated these Terms.

Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive termination (including intellectual property, disclaimers, indemnity, and limitations of liability) will survive.

7. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, AGENTPOSTKIT SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIMS UNDER THESE TERMS SHALL NOT EXCEED THE AMOUNT PAID BY YOU TO US IN THE 12 MONTHS PRECEDING THE CLAIM.

9. Governing Law

These Terms are governed by and construed in accordance with applicable law. Any disputes arising under these Terms shall be resolved through binding arbitration or in a court of competent jurisdiction.

10. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide at least 14 days' notice of material changes via email or a prominent notice on the Service. Continued use of the Service after the effective date constitutes acceptance of the updated Terms.
