Terms of Service

Please read these Terms of Service ("Terms") carefully before using the AgentPostKit platform operated by AgentPostKit ("we," "us," or "our"). By accessing or using the Service, you agree to be bound by these Terms.

1.Acceptance of Terms

By creating an account or using any part of the Service, you confirm that you are at least 18 years old, have the legal capacity to enter into these Terms, and agree to comply with them in full. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

2.Use of the Service

AgentPostKit provides a social media content management platform for real estate professionals. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable license to access and use the Service for your personal or internal business purposes.

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately at support@agentpostkit.com if you suspect unauthorized access.

AI-assisted content

AI tools are optional. Their outputs may be incomplete or inaccurate, and you must review and edit them before publishing.

You remain responsible for legal and platform compliance and for applying your professional judgment to all content you publish.

3.Subscription and Billing

Free trial

New accounts receive a free trial period as indicated at signup. No payment method is required during the trial. At the end of the trial, you must subscribe to continue using the Service.

Paid plans

Subscriptions are billed in advance on a monthly or annual basis, according to the billing interval you select, and renew automatically for the same interval until canceled. You may cancel at any time. Cancellation takes effect at the end of your current billing period, and you retain access until then. All fees are non-refundable except as required by applicable law.

We reserve the right to change pricing with 30 days' notice via email.
Payments are processed by Stripe. By subscribing, you agree to Stripe's terms.

Cancellation

You can manage or cancel your subscription from the Billing tab in Settings.

4.Intellectual Property

The Service and its original content, features, and functionality — including but not limited to the content library, templates, and software — are and will remain the exclusive property of AgentPostKit and its licensors.

You retain ownership of any original content you create using the Service. By using the Service to publish content, you represent that you have the right to do so and that your content does not infringe third-party rights.

Your content

Your Content means content that you submit, import, create, schedule, or instruct the Service to retrieve from a connected account. You and your licensors retain ownership of Your Content. This license does not transfer ownership to AgentPostKit or change the ownership of AgentPostKit or third-party materials described above.

You grant AgentPostKit a non-exclusive, limited license to host, store, cache, reproduce, format, customize, transmit, display, and publish Your Content solely as reasonably necessary to provide and improve the Service you use under these Terms. Customization and publishing must follow your instructions, including your selected settings, schedules, connected accounts, and audiences. Improvement under this license is limited to maintaining, testing, and troubleshooting the functionality used to deliver that Service. This license does not authorize selling Your Content, using it in our advertising, licensing it for independent use, or training general-purpose AI models.

We may sublicense these rights only to infrastructure and other service providers, including providers of optional features you choose, and to social platforms you connect, solely to the extent necessary to deliver the Service at your direction. This grant does not expand any rights you separately grant a third-party provider under its own terms.

You represent that you own Your Content or have all rights and permissions needed to submit, connect, import, customize, schedule, and publish it through the Service, and to grant this limited license. This includes any permissions needed for third-party materials and for people depicted or identified in Your Content.

Except for the limited purposes in this paragraph, this license ends for the affected content when you delete it from the Service, complete account deletion, or your access to the Service terminates. After deletion or termination, the license continues only to the extent and for the time reasonably necessary to complete deletion and provider propagation, retain copies in transient backups pending routine expiry, or comply with legally required retention. Retained copies may be used only for those purposes, not for new publishing, Service improvement, or unrelated commercial use. These limits also apply to the service-delivery sublicenses we grant and govern survival of this license under Section 6.

Deleting content or your AgentPostKit account does not itself remove posts already published to a social platform or copies held by that platform or its users. Removal and propagation through third-party systems depend on their controls and terms. 5.Prohibited Activities

You agree not to:

Use the Service to violate any applicable local, national, or international law
Transmit spam, unsolicited messages, or bulk commercial communications
Upload or transmit viruses, malware, or other harmful code
Attempt to gain unauthorized access to any part of the Service or its systems
Reverse-engineer, decompile, or disassemble any part of the Service
Use automated tools (bots, scrapers) to access the Service without our written consent
Impersonate any person or entity, or misrepresent your affiliation
Use the Service in any way that could harm, disable, overburden, or impair its availability or accessibility

6.Termination

We may suspend or terminate your access to the Service at any time, with or without cause or notice, including if we reasonably believe you have violated these Terms.

Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive termination (including intellectual property, disclaimers, indemnity, and limitations of liability) will survive.

7.Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components.

8.Limitation of Liability

To the maximum extent permitted by law, AgentPostKit shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data or goodwill, arising out of or in connection with your use of the Service. Our total liability for any claims under these Terms shall not exceed the amount paid by you to us in the 12 months preceding the claim.

9.Governing Law

These Terms are governed by and construed in accordance with applicable law. Any disputes arising under these Terms shall be resolved through binding arbitration or in a court of competent jurisdiction.

10.Changes to Terms

We reserve the right to modify these Terms at any time. We will provide at least 14 days' notice of material changes via email or a prominent notice on the Service. Continued use of the Service after the effective date constitutes acceptance of the updated Terms.
